Article 1 – Scope
These general terms and conditions apply to direct bookings made on lesmeublesdeluchon.com. Bookings made through a third-party platform are governed primarily by that platform's own booking, payment and cancellation terms.
Article 2 – Purpose and duration
This contract sets out the rights and obligations of the parties for the seasonal rental of the designated accommodation, for the agreed period. The tenant may not claim any right to remain on the premises after the end of the stay.
Article 3 – Booking
The tenant agrees to respect the maximum occupancy of the accommodation. The booking becomes final once the requested information has been provided, these terms accepted, payment made in full, and a confirmation sent by email. The booking is personal and may not be transferred without the owner's written consent.
Article 4 – Price
The amount paid at booking includes the rental price, the cleaning fee and the applicable tourist tax. Bed linen, bath towels and pet accommodation are optional and are subject to a separate request and payment from the tenant, under the conditions set out in Article 9.
Article 5 – Cancellation by the tenant
Cancellation must be requested by email. Up to fourteen calendar days before arrival, cancellation is free of charge and amounts paid are refunded via the original payment method. Within fourteen days of arrival, the rental price remains due to the owner. Unused optional services and any tourist tax collected directly are refunded. No-shows and stays cut short at the tenant's initiative do not entitle the tenant to any refund of the rental price.
Article 6 – Cancellation by the owner
Should the owner cancel before the stay, the tenant is notified promptly and the amounts paid are refunded. If the cancellation results from a failure on the owner's part, the tenant may seek compensation for direct and justified loss under the applicable legal conditions. In the event of force majeure within the meaning of Article 1218 of the French Civil Code, the obligations are suspended or the contract is terminated depending on the circumstances. Services not provided are refunded without further compensation.
Article 7 – Arrival and departure
Check-in is possible from 4pm and the accommodation must be vacated by 10am at the latest. Access is via a key safe. Any access issue must be reported to the owner.
Article 8 – Payment
The stay is payable in full at the time of booking via Stripe. The owner neither receives nor retains full card details.
Article 9 – Optional services
The following services are available on request sent to the owner by email: bed linen: €20 per bed; bath towels: €10 per person; pet allowed: €50 per stay. Once accepted, a secure payment link is sent to the tenant and the service is confirmed once payment is validated. It is recommended to make the request at least 24 hours before arrival; later requests are accepted subject to organisational availability.
Article 10 – Condition of the accommodation and cleaning
Any issue must be reported as soon as it is noticed. End-of-stay cleaning is included in the price, but the accommodation must be left reasonably tidy: dishes washed, fridge emptied, rubbish taken out and furniture put back in place. Noticeably excessive mess requiring additional intervention may be charged, with supporting evidence.
Article 11 – Damages
No security deposit is requested, without this limiting the tenant's liability. The tenant is liable for damage, loss or deterioration caused by them or by persons or pets accompanying them. The owner informs the tenant of any damage found and provides available supporting evidence. Reasonable costs may be charged, after taking into account normal wear and tear.
Article 12 – Use of the premises
The tenant makes peaceful use of the accommodation and its facilities, and respects the neighbourhood and shared areas. Parties, noise disturbances, sub-letting and commercial activities are prohibited.
Article 13 – Occupancy
The number of occupants may not exceed the maximum capacity of the accommodation. The owner may refuse additional persons. If an overrun is noted during the stay, the tenant must immediately correct the situation; failing this, the owner may end the stay, subject to applicable legal provisions.
Article 14 – Pets
Only one pet is allowed, subject to written authorisation and payment of the supplement set out in Article 9. The tenant is liable for any damage, disturbance or cleaning caused by the pet. The pet must not get on the beds, its waste must be picked up, and it must never be left alone in the accommodation.
Article 15 – Complaints
Any complaint should be sent to azemarluchon@gmail.com, stating its subject and any relevant supporting evidence. An amicable solution will be sought as a priority.
Article 16 – Mediation and disputes
These terms are governed by French law. After a prior written complaint that has not led to an amicable solution, the consumer tenant may refer the matter free of charge to: Médiation Tourisme et Voyage — CS 30958 — 75383 Paris Cedex 08 — www.mtv.travel. The referral is made under the mediator's own terms. Failing an amicable resolution, the dispute may be brought before the legally competent court.
